Agreement to Terms
By using our website or hiring UrbanWorks Westfield Concrete for services, you agree to these Terms of Service. Please read them carefully. If you do not agree with any part of these terms, please do not use our website or services. We reserve the right to update these terms at any time, and your continued use of our services constitutes acceptance of any changes.
Services Provided
UrbanWorks Westfield Concrete provides professional concrete installation, repair, and related services for residential and commercial properties. All services are subject to availability, weather conditions, and material supply. We reserve the right to decline any project that we determine is not suitable for our expertise or resources.
Estimates provided are based on the information available at the time of inspection. If site conditions differ from what was initially assessed, we reserve the right to adjust pricing accordingly. Any changes to scope or pricing will be communicated to you before proceeding with additional work.
Payment Terms
Payment terms will be outlined in your written estimate or contract. We typically require a deposit before beginning work, with the balance due upon completion. We accept cash, check, and major credit cards. Late payments may be subject to interest charges as permitted by Massachusetts law. You are responsible for payment even if you are seeking reimbursement from insurance or other third parties.
Warranties and Guarantees
We stand behind the quality of our work and offer warranties on labor and workmanship as specified in your service agreement. These warranties do not cover damage caused by improper use, neglect, natural disasters, or normal wear and tear. Concrete is a natural material that may develop minor surface cracks over time due to settling, temperature changes, or other environmental factors. Such minor cracking does not indicate a defect in workmanship.
To maintain your warranty, you must follow all recommended maintenance procedures and allow us to inspect and repair any issues that arise during the warranty period. Warranty claims must be submitted in writing within the specified warranty period.
Limitation of Liability
UrbanWorks Westfield Concrete will not be liable for any indirect, incidental, or consequential damages arising from our services. Our total liability for any claim related to our services will not exceed the amount you paid for those services. We maintain liability insurance as required by law, and all claims must be submitted in accordance with our insurance policy terms.
Property Access and Safety
You agree to provide clear access to the work area and ensure that the site is safe for our crew to perform the work. You are responsible for identifying and marking any underground utilities, sprinkler systems, or other hidden obstacles before we begin work. We will take reasonable precautions to protect your property, but we are not responsible for damage to unmarked utilities or obstacles that were not disclosed to us.
You agree to keep children and pets away from the work area during construction and curing periods. Fresh concrete is a hazard, and we cannot be responsible for injuries or damage that occur when safety barriers are breached.
Cancellation and Rescheduling
If you need to cancel or reschedule your project, please notify us as soon as possible. Cancellations made after materials have been ordered or work has begun may result in charges for materials and labor already incurred. We reserve the right to reschedule work due to weather conditions, equipment issues, or other circumstances beyond our control.
Dispute Resolution
If you have any concerns or disputes regarding our services, please contact us directly so we can work together to find a resolution. Most issues can be resolved through open communication. If a dispute cannot be resolved informally, you agree to pursue resolution through mediation or arbitration in Hampden County, Massachusetts before filing any legal action.
Governing Law
These Terms of Service are governed by the laws of the Commonwealth of Massachusetts. Any legal action must be brought in the appropriate court in Hampden County, Massachusetts.
